Docs 4 Patient Care Endorses Plan to Replace Georgia's Medical Malpractice System

ATLANTA, Feb. 26, 2013 /PRNewswire-iReach/ -- The Georgia chapter of Docs 4 Patient Care, a physicians group dedicated to preserving the doctor-patient relationship, today endorsed the "Patient Injury Act," a proposal before the Georgia Legislature that would replace the state's medical malpractice system with a no-blame, administrative model.

The legislation, if adopted and signed into law, would create the first Patients' Compensation System (PCS) in the nation in which no doctor would ever be sued again if they harmed a patient.  Instead, a patient would file an application for investigation with the PCS independent panel of medical experts who, if found a medical injury should have been avoided, would send the claim to a compensation office for compensation. The patient would receive no less compensation than under the current, adversarial tort system.

"Docs 4 Patient Care, Georgia Chapter, supports the PFC system (Patients for Fair Compensation) because the plan attempts to fix the diseased system," said Dr. Jeff English, president of the Georgia chapter of Docs 4 Patient Care. "Under the plan, patients who believe they may be victims of medical errors will receive an expedited review of the facts by an independent, educated panel.  Physicians will reduce defensive medicine as they will feel confident their treatment will be reviewed by an expert medical panel.  They will know that only true medical errors will move forward in the review process."

English added: "Compensation will be allocated in an expedited fashion when there are true medical mistakes.  Finally, the medical community will be educated about mistakes, preventing similar harm to others."

"Physicians will stop practicing defensive medicine when they know they will not be taken to court," said Dr. English. "This system is a win-win for everyone as it will reduce healthcare costs for consumers, taxpayers and physicians."

The Patient Injury Act is now in the Georgia Senate and will be heard in the Senate Health and Human Services Committee this week.
